These Terms & Conditions ("Terms") govern your use of texasesaletter.org (the "Site") and the services offered through it. By using the Site or booking an appointment, you agree to these Terms. If you do not agree, please do not use the Site.
1. Our service
texasesaletter.org connects Texas residents with licensed mental health professionals for emotional support animal (ESA) evaluations conducted via telehealth. If, in the clinician's independent professional judgment, an ESA is appropriate for you, the clinician will issue an ESA letter.
2. No guaranteed approval
An ESA letter is issued only when clinically appropriate. Booking an appointment or paying a fee does not guarantee that you will receive a letter. Clinicians exercise independent professional judgment, and we will never override a clinical decision.
3. Eligibility
- You must be at least 18 years of age.
- You must be a resident of the state of Texas.
- You must provide accurate, truthful information during booking and evaluation.
4. Not emergency or ongoing care
Our service provides ESA evaluations only. It is not a substitute for ongoing therapy, psychiatric care, or emergency services. If you are experiencing a mental health emergency, call or text 988 (Suicide & Crisis Lifeline) or dial 911.
5. Scope and use of ESA letters
A valid ESA letter may support a reasonable accommodation request under the federal Fair Housing Act. Housing providers may verify the letter and, in limited circumstances, may lawfully deny a request. Airlines are generally no longer required to accommodate ESAs in the cabin. We make no guarantee regarding how any third party will treat your letter.
6. Fees and refunds
- Fees are listed on our Pricing page.
- Payment after approval: you are charged only after the clinician approves your letter. If the clinician determines that an ESA letter is not appropriate for you, you are not charged.
- Completed evaluations that result in an issued letter are non-refundable.
- Refund requests should be sent to contact@texasesaletter.org.
7. Your responsibilities
- Provide truthful and complete information.
- Use your letter honestly and lawfully. Misrepresenting an animal as an assistance animal can carry legal penalties under Texas law.
- Keep your contact information current so we can deliver your letter and confirmations.
8. Intellectual property
All content on the Site — text, design, graphics, and logos — is owned by or licensed to texasesaletter.org and may not be copied or reused without permission.
9. Disclaimers
The Site and its content are provided "as is" without warranties of any kind. General information on this Site is educational and is not legal or medical advice.
10. Limitation of liability
To the maximum extent permitted by law, texasesaletter.org will not be liable for indirect, incidental, or consequential damages arising from your use of the Site or services. Our total liability for any claim will not exceed the amount you paid for the service giving rise to the claim.
11. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date reflects the latest version. Continued use of the Site after changes means you accept the updated Terms.
